Who is Chesa Boudin?

Chesa Boudin is an American attorney who since 8th January 2020 serves as the 29th district attorney of San Francisco. Chesa previously worked as San Francisco’s Deputy Public Defender. Boudin lobbied Andrew Cuomo, New York Governor, in November 2020 to commute the 75-year-to-life prison sentence of David Gilbert. David is the last Weather Underground member incarcerated for their involvement in the 1981 Brink robbery and three related murders.

Ela Gandhi, Bernice King, and Archbishop Desmond Tutu, among other faith leaders, support the effort and it is led by Steve Zeidman, CUNY School of Law professor. They cite David’s clean prison record and increased COVID-19 risk in prison as arguments for his clemency.

The appeal is contested by murder victims. Andrew Cuomo commuted Mr. Gilbert’s sentence on his final night as Governor of New York State. He made David eligible to apply for parole. Boudin’s grandfather had a history as an attorney and his uncle Michael Boudin is a judge.

Boudin was born in New York City to Kathy Boudin and David Gilbert. His parents have Jewish Ancestry. They were both members of the Weather Underground and were convicted of murder. Boudin’s parents were arrested when he was 14 months old. They were convicted of murder in their role as getaway car drivers in the Brink’s robbery of 1981 in Rockland County, New York.

Kathy, his mother was sentenced to 20years to life. David, his father was sentenced to 75 years to life for the felony murders of two police officers and a security guard. Chesa was adopted by Bill Ayers and Bernardine Dohrn, after the sentence of his parents. His adoptive parents were also members of Weather Underground. In 2003, Kathy Boudin, Chesa’s mother was released under parole supervision.

Chesa Boudin Career

Boudin went to Venezuela before he attended law school. He served as a translator during the administration of Hugo Chavez in the Venezuelan Presidential Palace.

Between 2011 and 2012, Chesa worked on the United States Court of Appeals for the Ninth Circuit as a law clerk to M. Margaret McKeown. Between 2012 and 2013, he served as a Fellow at the San Francisco Public Defender’s Office. The 2019 election

In the 2019 election, Chesa was elected San Francisco District Attorney. He won against interim district attorney Suzy Loftus. He campaigned for the office on a decarceration platform of eliminating cash bail. Boudin established a unit to re-evaluate wrongful convictions. He refused to assist Immigration and Customs Enforcement (ICE) with raids and arrests. Chesa was criticized by Attorney General William Barr.

San Francisco district attorney

On 8th January 2020, Boudin was sworn in by San Francisco Mayor London Breed as a San Francisco district attorney. He restructured his management team by sacking seven prosecutors.

Boudin implemented a diversion program for primary caregiver parents of minor children who were charged with misdemeanors or nonviolent felonies, in accordance with SB394 as his first policy as the district attorney. This bill was written by Nancy Skinner and was signed into law in October 2019 by Gavin Newsom.

Chesa eliminated cash bail on 22nd January and replaced it with a risk-based system. Boudin reduced San Francisco’s jail population by 25% during the COVID-19 pandemic. He prioritized older inmates and those with medical conditions. Prisoners charged with misdemeanors were considered for home detention. In April 2020 the reduction increased to around 40%.

A group of district attorneys both active and retired including Boudin, Diana Becton, and George Gascón urged the State Bar of California to prohibit elected prosecutors from accepting campaign contributions from police unions on 1st June 2020.

Boudin introduced a new policy in June 2020 that required prosecutors to review all available evidence before charging any cases that involves allegations of resisting or obstructing police officers.

Chesa charged Dwayne Grayson, a 20-year-old boy in March 2020 with elder abuse. Grayson filmed Jonathan Amerson, a 56-year old man in February 2020 swinging a metal bar at an elderly Asian man in San Francisco. Jonathan was charged with robbery and elderly abuse. Boudin dropped charges against Dwayne after he explained his intentions to seek restorative justice.

The COVID-19 Pandemic

Mayor London Breed, Chesa, and San Francisco’s Human Services Agency announced their acquisition of 20 temporary housing units for victims of domestic violence on 9th April 2020. The domestic violence victims were from the city’s largest landlord, Veritas Investments, during the 2020 stay-at-home orders in San Francisco during the COVID-19 pandemic. Boudin also partnered with Lyft and AirBnB for the provision of transportation and temporary housing services to survivors during the pandemic.

In April 2020, Chesa and his office launched the Economic Crimes Against Workers Unit. It was led by Scott Stillman, Assistant District Attorney. Boudin filed a suit in June 2020 against DoorDash. The motion is similar to suits made by Xavier Becerra and Dennis Herrera, California public attorneys.

Hampton was shot and injured in an altercation with police. His charges were pulled without prejudice. On 29th April 2021, Hampton was charged with assault with a deadly weapon and other felonies by the District Attorney’s Office. Boudin suspended the process of prosecuting Jamaica Hampton on January 26.

On 28th February 2021, Chesa announced that his office would no longer seek charges for contraband found during “pretextual” traffic stops.

Jerry Lyons ran a red light in a stolen Ford Explorer in February 2021 and killed Sheria Musyoka near Lake Merced. He was detained for 27 days for violation of his probation. Boudin asked for a blood toxicology report before pressing charges.
